"TJ" was
purchased by Ana Herrera of IMOKAM
Aussies in Spain June of 2006. Upon purchase
Mrs. Herrera was made aware of "TJ's" health clearances (OFA'd Good, Elbows
Normal/Normal, current eye CERF 2006), AKC championship and
he had produced a litter (see pictures below) born June 2nd. 2006. As
unfortunate as it is, "TJ" became sterile within 18 months
AFTER arriving in Spain at Mrs. Herrera home.
Mrs. Herrera has
wrote numerous derogatory emails to USASA,
AKC and ASCA in regards of TJ sterility. These are a few of Mrs. Herrera's emails she sent to the above
listed clubs claiming fraud.

In June 06
I bought to Patti Herhold - Snowbelt - an AKC champion black
tri
boy for show and breeding. That boy has been shown here in
Europe finnishing
2 championships (Spain and Gibraltar) and he is pointed in 2
more (Portugal
and FCI International) but I couldn't use him for breeding,
firstly girls
were empty and last July in 2 vet examinations the diagnosis
was confirmed :
he is STERILE (the official vet certificate is attach in
this e-mail).
On 29 of
July 2008 I notified to Patti Herhold the results of the vet
examinations and I received only questions and sorry words,
on 6 of August
the official vet certificate was sent to her and no reply
until now.
I'm
completely devastated and I'm not sure what to do and how to
act so I'd
like to know if you have rules, laws, ... to solve this kind
of actions:
sell for breeding a sterile dog (at least here in my country
this is a very
unethical act able to be penalized).

At least
here in my country the correct is to reply the received
e-mails (your last mails dated 19 of September, after that
mine are dated 13 October, 24 October, 25 November, 8
December).
There
are more than 3 months I contacted to your club to ask about
ethic codes and how to do in view of what I considered a
fraud (if for you is normal to sell a dog for breeding and
he is sterile, so we can finnish this subject) and from them
I saw how the confidentiality in the mail from any member of
---- ------ (and because that I had to hold on an e-mail that
neither I don't think it's normal and that it'll take
actions ... there is it?) and the solution to all these is
an apology from you and an attempt to mediate in this
subject that finally went to NOTHING (well, yes, you made me
to loose some months and finnish to convince that for you
all these incidents are usual, go in legality and not give
them no important). I have to say you that you dissapoint me
COMPLETELY.
From now
and after months lost, night without sleep, health's
problems, ... I'll have to handle by myself and
without help this subjet, so I'd ask you that you forget my
request and I let off your offer: don't loose one minute
more of your time (if really you thought to do it) with this
subject.
If
anytime you need anything from my country let me know (may
be you will surprise how we do some people in this part of
the world)

First of all, let me say
that, although you have my sympathy for the condition of
TJ as described by your Veterinarian, I will accept no
responsibility for such condition. TJ was in perfect
health and condition when he was shipped to you 18 months
prior as witnessed by corresponding health certificates,
OFA & CERF reports and the birth of a litter born 06-02-06
to Myshara's Lexus, a breeding I witnessed myself. This
litter in itself rules out TJ's problem as hereditary, but
suggests the possibility of an environmental trigger ie.
injury, virus, fever or chemical exposure. TJ's sire is a
Record Of Merit sire with multiple offspring, including
sons and daughters producing well and his dam is also
still producing litters.
I am prepared to offer you
a black tri male show quality puppy from a current or
upcoming litter within the next year. I will absorb costs
of raising the puppy to four months of age, his initial
vaccinations (DHLPPv and Rabies), and microchip ID. Your
financial responsibility will include necessary health
charts, crate and shipping. I do not consider this a
replacement, but rather a "good faith" offering.
I would NEVER knowingly
have sold you or anyone a defective dog and I am hurt by
your accusations of fraud. I hope you will consider my
offer and I await your response.
